COPPA NOTICE TO SCHOOLS WITH RESPECT TO CHILDREN’S USE OF THE LEARNING.COM PRODUCT

1. Introduction

Learning.com provides solutions to help students, teachers, and schools excel in a digital world. We are excited to help support student growth, but also realize we are being entrusted with great responsibility.

This Notice is intended to satisfy The Learning Internet, Inc.’s (dba Learning.com) (“Learning.com”, “us”, “we” or “our”) obligation under the Children’s Online Privacy Protection Act (“COPPA”) to provide educational institutions (“Schools”) who have subscribed to the Learning.com digital education services, including the Learning.com management platform available at https://www.learning.com (collectively, “Services”) with notice regarding our practices as to the collection, use, or disclosure of Student Data (as defined below) on behalf of the School.

In the course of providing its Services to a School, Learning.com may have access to certain personal information about students who are under 13 that is provided by the School as well as information that is provided directly by a student to Learning.com or otherwise collected by Learning.com in connection with the student’s use of the Services (“Student Data”). Learning.com does not knowingly collect Student Data unless and until the School has obtained appropriate parental consent for the student to use the Services. Because Learning.com collects and uses Student Data at the direction of and under the control of a School, Learning.com relies on each School to provide appropriate notice to parents regarding the collection, use, or disclosure of Student Data, and for the School to provide consent, if necessary, and authorization for Learning.com to collect Student Data, as permitted by COPPA.

Please contact us if you believe we have inadvertently collected Student Data without proper consent so that we may delete such data as soon as possible.

2. Information We Collect

Learning.com may collect the following Student Data:

  • Full name, which is displayed on the platform for personalization of the student experience, and it is used in reports provided back to the teacher and district;
  • Username or unique identifier and password, which allow students to log-in to the platform;
  • Email address (optional, if the School so chooses);
  • The school a student attends, which is used in aggregate reporting to show activity and progress grouped by school within a district;
  • Associated grade level, class names, and teacher names, which are displayed to educators for the purpose of locating specific students and identifying appropriate content;
  • District user ID, which is collected to use for synchronization with the district student information system (SIS) when a district is configured for sync with Learning.com. It is used to facilitate single sign on from certain external systems;
  • Student in-platform performance data and usage data, such as scores earned on activities, which content is used most often, how long activities take to complete, and which features within our applications are interacted with most and least;
  • Communications to teachers or School staff from within the platform;
  • Conduct or performance data input by teachers or School staff; and
  • Student generated content. Some curriculum items allow a student to provide generated work as a response, such as question responses and document attachments. The student responses are made available to the teacher to review and score the work.

3. How We Use Information

We use Student Data only for educational purposes at the direction of the School and in accordance with our contract with the School, including to improve our educational products and for security and safety purposes, or as required by law or to enforce our terms of service. We do not use Student Data for targeted advertising purposes.

4. How We Disclose Information

We disclose Student Data to third parties only as authorized and permitted by the School or as permitted by applicable laws. We may disclose Student Data to third parties in the following circumstances:

  • Within the platform: We may disclose Student Data within the platform as needed to perform the Services and/or at the direction of the School. For example, Student Data may be shared between and among authorized School users such as teachers and School administrators.
  • Service providers: We may disclose Student Data to third party companies and individuals that provide services on our behalf (such as web hosting and analytics services), for the purpose of carrying out their work for us. We require such companies and individuals who may have access to Student Data in the course of performing their services to us to protect the confidentiality and security of the data.
  • Authorities and others: We may disclose Student Data to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate to comply with applicable laws, lawful requests, and legal process, protect our, students’ or others’ rights, privacy, safety or property (including by making and defending legal claims), enforcing the terms and conditions that govern our Services, and preventing, identifying, investigating and deterring fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
  • Business transfers: We may sell, transfer or otherwise share some or all of our business or assets, which may include Student Data, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Notice.

5. Data Retention

We will not retain Student Data for any longer than is necessary for educational purposes and legal obligations, or to provide the Services for which we receive or collect the Student Data. Following termination or deactivation of a School account, Learning.com may retain School profile information and content for a commercially reasonable time for backup, archival, or audit purposes, but any and all Student Data associated with the School will be deleted promptly. We may maintain de-identified or aggregated data, including usage data, for analytics purposes, unless otherwise agreed with a School.

6. Privacy Choices

Upon request from the School, Learning.com will provide the School a description of the types of Student Data collected, an opportunity to review the Student Data and the right to have Student Data deleted, and an opportunity to prevent further use or online collection of Student Data.
